what are the legalities?

what are the legalities of using a photo as reference t0o draw a sword or a house etc. i know people copyright thier photos or whatever saying that you cant use them but what about drawing the content of the photo? if you can use thier photos id like to make some tutorials in photoshop for people who cant really draw so maybe they can go about it this way.

I would say if you were using a photo for reference , and not a duplicate, then it would be fine. In any event, obtaining the permission of the photographer is a must. Just be sure to explain to him what your intentions for using his photo are, watermark his photo with his URL/Name and tell people to be creative, not to carbon copy their reference pic.

I. Fair Use for Teaching and Research

I think the idea of "fair use" will allow you to use scanned photos as a reference material for teaching without necessity to license the work.

Too bad DJ's not a teacher, and the people whom he's teaching are probably makign their games for profit. It's not hard at all to ask for permission, a quick, well thought out email to the author, and you'd be surprised at the number of yes replies you get. Bottom line is, play fair, nobody wants to be ripped off.

the whole problem is i was tryng to think of a way to help people draw without knowing how per say. now true it would be easy for me to get permission for a picture etc but for someone making a game who cant draw and they relied on this method it would go nowhere fast. i think, i think ill work towards another idea to help people with drawing basic items and stuff.
