Something epic this way comes. Movie Trilogy of the Lord of the Rings. I am insane with joy. I am insane with waiting a year to see it. IMHO the greatest books of all time.
Now on to my excuse for posting this to the webboard {I've got a million of em }
I am planning on using Coldstone to make an RPG, which i have already started planning. Something that troubles me... I am being heavily influenced by my love of these books. Now mind you I don't mean im going to copy anything from it, {save possibly a minor few things, such as calling a food item waybread } but I do intend to use some things found in it. Something i want to know, are creatures such as Orcs and Ents common to legends and myths like elves and goblins, or are these creations of Tolkiens? {I have not read extensively into this type of thing, save LOTR}
I have to say that EV3 and Halo have both been bumped down a notch for these movies on my Things I Wish I Could Get list. Sorry Ambrosia :frown:

But they only call them "halflings" in LOTR because they're half as tall. Halflings in RPGs usually refer to a half-elf/half-human being or something.

TSR, the company that makes Dungeons & Dragons, and other RPG games, got taken to court for their use of the word hobbit in their games/novels. They had to change the name 'hobbit' to 'halfling' to avoid further copyright issues.

They were thinking that they could get away with plagerizing (sp) Tolkien's work. Ever read the Icewind Dale Trilogy , a series set in the world of Faerun ( Forgotten Realms )? Most of the second book is (or sounds like it is) Tolkien -- but that's what people say about all of R.A. Salvatore's work.
Just to let anyone know, I found a really good site of LoTR resources: (url="http://"http://www.theonering.net")www.theonering.net(/url) It's got loads of news about the film, plus some information about a VERY cool Ultima Online style game called Middle Earth Online. It's for the PC only, but I'm gonna be buying one of those whizzy AMD 750Mhz Laptops soon, so I won't have any problems.

gah! that book is one beastly foe! I remember I tried to read it as a young teen -- the damn thing nearly killed me. that was Tolkien's real pride and joy. he spent 50 years writing and still never really came to any conclusion about it. his children just published what they could collect and make sense of at the time of his death. the trillogy was just an incorperation of his established characters from The Hobbit into the greater story of the Silmarillion.

The Tolkien estate didn't like their use of 'Ent', either. Note that to this day, 'mithril' is spelled 'mithral' in D&D; supplements. Same thing.
A small but important niggle: TSR was never taken to court over that issue. They received a nastygram from the Tolkien estate, and since TSR consisted of three guys in a basement at the time they decided to comply rather than lock horns with a small army of ill-tempered and well-financed lawyers. That doesn't mean they were in the right, necessarily, but it means they weren't necessarily in the wrong either. 'Character copyright,' which Tolkien was availing itself of, is a (relatively) recent and tenuous thing.
At any rate, since ideas can't be copyrighted, you can "shave the serial numbers off" and make a game that is Tolkienesque in all but the names. A whole thriving industry was born because of that detail.
Lastly, as a purely practical matter, you really don't want to cross swords with the Tolkien estate. You might be right and they might be wrong, but if you want to find that out the hard way you'll get hurt doing it. And, of course, you might be found to be wrong.
Elves, dwarves, orcs, wights, and gnomes all have deep roots in mythology. Tolkien borrowed and adapted the names and the legends behind them for his own purposes, so his estate doesn't own them in general. It does, however, have a stake in his particular names for them (sindar, noldor, naugrim, yrch, etc.)
On a lighter note, the Silmarillion is actually my favorite of his works. It's not really a story, but I find the sheer sweeping immensity of it, and the larger-than-life nature of the characters, to be completely immersive. The other books become a lot more interesting after you read it, too. "Oh, that's what Galadriel's talking about..."
